Banner Health, nurse, reach settlement in wrongful death lawsuit

WORLAND — A settlement has been reached in a wrongful death lawsuit in the Wyoming Fifth Judicial District Court.

Court documents filed Wednesday indicate that Banner Health Corporation and Washakie Medical Center nurse Donna Clothier have settled with Stephanie Anderson for an undisclosed monetary amount in connection with the alleged wrongful death of her husband, Kevin Anderson.

Edward Zimmerman, M.D., is also named in the lawsuit. He is still facing a lawsuit which alleges he is responsible for the death of Kevin Anderson.

According to court documents, in 2013, Kevin Anderson visited the Banner Health Washakie Medical Center emergency room in Worland after experiencing abdominal pain. Zimmerman administered hydromorphone, an opioid pain killer, to Anderson before he was released.

The next morning, Stephanie Anderson awoke and discovered that her husband had died.

The lawsuit alleges that Zimmerman caused Anderson to overdose on hydromorphone, leading to his death.

Worland Attorney Christopher King is representing Anderson in the case. King said that the matter has concluded in respect to Clothier and Banner Health, but there is still pending litigation regarding Zimmerman.

Banner Health spokesperson Sara Quale said that Banner Health does not comment on pending litigation. Banner Health and Clothier were represented by Michael McConnell of Denver, Colo.

A trial date regarding the matter for Zimmerman is set for August 2016.
